These General Terms and Conditions (AGB) apply to all services of Jobpic (jobpic.io), operated by:

By using the service, the user agrees to these Terms and Conditions. Deviating conditions of the user are not recognised unless Jobpic expressly agrees to their validity in writing.
Jobpic offers an AI-powered service for generating professional headshots and portrait photos. The service uses the Google Gemini API for image processing. Users upload a photo, choose style, outfit and scene, and receive AI-generated professional headshots.
The quality of the results depends significantly on the quality of the uploaded photos. A guarantee for specific results cannot be given. The service is available via the web app at jobpic.io.
The contract between the user and Jobpic is concluded upon creation of a user account. Registration is done via email address and password through Firebase Authentication.
The user must be at least 18 years old or have the consent of a legal guardian. The user is responsible for the security of their account and the accuracy of their information. Only one account per person is permitted.
Jobpic operates on a credit-based model (no subscription). The following packages are available:
All prices include statutory VAT. Purchased credits do not expire. Jobpic reserves the right to change prices for future purchases. Previously purchased credits remain valid at the purchase price.
Payment processing is handled by Stripe (Stripe Technology Europe Limited, Dublin, Ireland). Payment is due immediately upon purchase. Jobpic does not store payment card data. Stripe's terms and conditions apply to payment processing.

The user receives a non-exclusive, unlimited-in-time right to use the generated images for personal and commercial purposes (e.g. LinkedIn, job applications, websites).
Jobpic reserves the right to use anonymised and aggregated data to improve the service. The user may not use the generated images for illegal, misleading or fraudulent purposes.
The user undertakes not to misuse the service. In particular, it is prohibited to:
Violations of these terms may result in immediate account termination without refund.
Jobpic is only liable for intent and gross negligence. In cases of minor negligence, liability is limited to foreseeable, typical contractual damages.

This does not apply to liability for injury to life, body or health, or to mandatory statutory grounds for liability.
Consumers have a statutory right of withdrawal of 14 days under distance selling law.
Withdrawal Notice
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must inform us (Bo Riedel-Petzold, Prießnitzstraße 41, 04179 Leipzig, Email: boriedel(at)gmail.com) by means of an unambiguous statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Important note: The right of withdrawal for digital content expires prematurely if execution of the contract has begun and the user has expressly consented (pursuant to § 356(5) BGB). By purchasing credits and using the service, the user expressly agrees to the commencement of performance and acknowledges the loss of the right of withdrawal.

Jobpic reserves the right to change these Terms with reasonable advance notice. Continued use of the service after the notice period expires constitutes agreement to the amended Terms. The current version is always available at jobpic.io/agb .
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should any provision of these Terms be invalid, the validity of the remaining provisions shall not be affected.
For consumers, the statutory place of jurisdiction applies. For merchants, the place of jurisdiction is Leipzig.
